If you are an individual who was notified that your Private Information was potentially compromised in the May and June 2023 Cybersecurity Incident where cybercriminals potentially accessed Nice-Pak Products, Inc. and Professional Disposables International Inc. systems between May 28, 2023, through June 15, 2023, you may be a Class Member and eligible for Settlement Benefits. Excluded from the Settlement Class are: (i) Defendants and Defendants’ parents, subsidiaries, affiliates, officers and directors, and any entity in which Defendants have a controlling interest; (ii) all individuals who make a timely election to be excluded from this settlement using the correct protocol for opting-out; (iii) any and all federal, state, or local governments, including but not limited to their departments, agencies, divisions, bureaus, boards, sections, groups, counsels and/or subdivisions; (iv) the lawyers representing the Parties in the lawsuit; (v) all judges assigned to hear any aspect of the lawsuit, as well as their court staff and immediate family members; and (vi) any person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the Cybersecurity Incident, or who pleads nolo contendere to any such charge.
If you are a Class Member and wish to receive Settlement Benefits then you must submit a claim form by May 12, 2026.
Constar Financial Services have agreed to pay for a number of benefits. You may claim as many benefits are you qualify for.
Privacy Shield Pro. All Class Members are eligible to enroll in three (3) years of Privacy Shield Pro and this includes:
Reimbursement for Lost Time. Class Members who spent time responding to the Data Incident may claim up to four hours, at $22.50 per hour, for a maximum of $90.00. You must have spent the time on tasks related to the Data Incident. Some examples include things like:
You must briefly describe how you spent this time, and show how much time you spent.
Reimbursement for Ordinary Expenses (Out-of-Pocket Expenses). You may submit a Claim for reimbursement of out-of-pocket expenses, not to exceed, per Class Member, $50.00 without documentation and up to $450.00 total with documentation, for ordinary out-of-pocket expenses that are were incurred as a result of the Data Incident including:
long distance phone charges
cell phone charges (only if charged by the minute)
Internet usage charges (if charged by the minute or incurred solely as a result of the Data Incident)
professional fees including attorneys' fees, accountants' fees and fees for credit monitoring services and/or fraud resolution services incurred between May 28, 2023, and May 12, 2026.
freezing or unfreezing credit with any credit reporting agency
Reimbursement for Documented Extraordinary Losses (Losses for Identity Theft or Fraud). If you have documented expenses directly associated with dealing with identity theft or fraud, you can get back up to $4,500.00. The losses must have occurred between May 28, 2023, and May 12, 2026, and you will need to show:
You cannot claim a payment for expenses that have already been reimbursed by a third party.
If you are claiming for reimbursement for Ordinary Expenses totaling over $50.00 or Documented Extraordinary Losses, you will need to provide proof, like receipts, to show how much you spent or lost. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim.

The deadline to submit a Claim Form online or by email is May 12, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than May 12, 2026.
